Mediation and Collaborative Family Law

Where appropriate, we encourage our clients to engage in Alternative Dispute Resolution (ADR) in the form of mediation or Collaborative Family Law (negotiation). These cost-effective, child-focused methods of resolution help families avoid the stress and expense of litigation, delivering a resolution to the matter sooner.

A mediator works with the clients and resolves their conflict.

Family Law Mediation

Mediation allows clients to work together directly with a mediator to achieve results. The mediator is an informed, trained professional who can moderate, assist, and guide the conversation toward negotiated agreements. This process avoids the “broken telephone” approach, where a client’s communication occurs only through a lawyer or judge who has limited knowledge of the family but can affect decisions with long-lasting implications.

Our role in mediation is not to provide legal advice but to help facilitate discussions on the issues important to you and reach a settlement based on common ground.

The mediation itself may or may not involve lawyers being present. However, all parties should obtain independent legal advice (ILA) from a qualified family law lawyer before entering into any final agreements.

Collaborative Family Law

The Collaborative Family Law process is an out-of-court negotiation in which parties and their lawyers agree to work together to resolve the issues arising from the breakdown in the parties’ relationship.

Our family law lawyers can represent you during negotiations, helping you retain control over the resolution that will affect your life and those of your children moving forward.

If a settlement cannot be reached through negotiation, we will present you with all of your other available options, including litigation through the family court system. Given the settlement-minded and frank discussions between the parties during the Collaborative Family Law process, the lawyers involved should avoid becoming involved in any litigation in the relevant matter if the collaborative process breaks down.

Our goal is to empower you with a complete understanding of the next steps so you can confidently move your matters toward finality.
